According to the rules of international law, States, in the face of the most serious crimes, have an inescapable obligation, to their own citizens, but also to the international community, to investigate, prosecute and punish those responsible. The development of international criminal law and the binding character of States' obligations have not, however, prevented the prosecution of perpetrators of mass crimes from being often considered an impossible, unrealizable and even not always desirable task. This article will focus on such criticism against criminal law as an appropriate tool in the field of transitional justice |
