| This article focuses on the selection of the counterparty to the conclusion of a contract. It argues that a rejection of a counterparty or a conclusion of the contract in disadvantageous terms, due to personal characteristiscs of the counterparty, might be considered a discriminatory behaviour, against the principle of respect for the personality set in Article 70 of the Portuguese Civil Code. A relational analysis (towards an equality principle) is rejected in this field. | |||
