The present study aims to analyze the UN Declaration (2007) of Rights of Indigenous Peoples, using, as theoretical paradigm, the conceptual confrontation of the communitarian and liberal worldviews. From a communitarian perspective it?s will be proposed the principles of subsidiarity and solidarity due their political functionality in the decentralised and plurals States, because they are especially suited in the case of indigenous peoples or nations inside this States. Moreover, it?s will be developed, theoretically, the idea of legal pluralism and his consequences in the Law Theory and State Theory of the XXI century, due this plurality of the legal systems is a defining feature of the cultural and legal complexity in the postmodern society. |
