| The aim of this paper is to analyse the impact of the disability (physical, mental, intellectual or sensory) of one of the parents when attributing the guard and custody of children in a process of parentalbreakdown. It also examines the actions that the Administration may adopt in situations of risk and helplessness of children with parents with disabilities, and how the best interests of the child plays as a weighting element in the decisions of our courts. All this in the light of the Convention on the Rights of Persons with Disabilities and the doctrine established by the European Court of Human Rights | |||
