| Protection orders are the most widely used measures for the protection of gender and domestic violence victims because of the affectivity relationship between the parties. In Spain, protection orders are granted in criminal proceedings and require the existence of a prior event that, at least, has the characteristics of a crime. The Istanbul Convention establishes the obligation of prevention among the positive obligations. We could consider the use of civil protection measures focused on prevention instead of repression and punishment. Furthermore, it would allow us to move closer to other European countries as most of EU countries use civil protection orders. | |||
