Sustainable development is an ambiguous concept in itself: within the legal reasoning, it sometimes appears as an autonomous principle, or even as a general clause, a hermeneutic canon, a criterion of balance, an evaluation standard. It is the task of the interpreter to bring back into the fundamental rights a ?knowledge brand? endowed with intrinsic normativity, with the awareness that without reference to systematic data, i.e. to the guiding values of the legal system, everything becomes sustainable. This essay proposes a reading of the ?principle of sustainability? that starts from the bottom. Not from norms and dogmas, but from facts; that is, passing through jurisprudential cases where not only regulatory matrices and interests involved emerge, but also power technologies working behind the imaginary of sustainability. |
