| dc.description.abstract | Il contributo in esame, dopo aver descritto alcuni dei possibili impieghi delle intelligenze artificiali in sanità (a scopo clinico, protesico-riabilitativo e assistenziale), si sofferma sulla disciplina applicabile ai danni subiti dal paziente durante l’erogazione della prestazione medica resa attraverso i dispositivi robotici. Oltre alle norme appositamente previste nella Legge Gelli-Bianco, saranno esaminate possibili opzioni ricostruttive ricavate dall’interpretazione evolutiva delle ipotesi di responsabilità civile contenute nel codice civile, affiancate da quelle in tema di product liability. Si procede poi all’analisi critica, in una prospettiva de iure condendo, della recente proposta di direttiva europea sulla responsabilità extracontrattuale da intelligenza artificiale, e del possibile impatto sul regime nazionale della responsabilità del medico e della struttura sanitaria; The present contribution after describing some possible uses of artificial intelligence in healthcare sector (for clinical, prosthetic-rehabilitation and care purposes), focuses on the discipline applicable to the damage suffered by the patient during the provision of medical services rendered through robotic devices. In addition to the rules specifically provided for in the Gelli-Bianco Law, possible reconstructive options will be examined, starting from the civil liability hypotheses contained in the Civil Code through an evolutionary interpretation, and until those relating to product liability. The recent proposal for a European directive on non-contractual liability rules for artificial intelligence is then critically analysed from a de jure condendo perspective, together with its possible impact on the national regime of the responsibility of the doctor and the health structure. | es |
