: Los jueces asumen una posición sobre qué cuenta o no como derecho cuando resuelven casos. Parece entonces que deberían recibir una buena formación en teoría del derecho, que precisamente intenta ofrecer una respuesta a esa cuestión. En el trabajo analizo las dificultades relativas a la formación de los jueces en teoría del derecho. En la última parte, sostengo que debe formarse a los jueces en diversas teorías del derecho (plausibles) y que las partes del proceso deberían tener una mayor intervención en relación al derecho aplicable.Abstract: Judges take up a position on what counts as law when they decide a case. It seems, then, that they should get a good education in theory of law, which purports to provide an answer to that very question. In this paper, I analyze the difficulties regarding the education of judges in legal theory. In the last part, I argue that judges should be educated in several (plausible) theories of law and that the parties in litigation should have a greater say in relation to the applicable law.
